Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PumpedReels (“the Service”), operated by HuMe GmbH (“we,” “us”). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you confirm that you meet this age requirement.

2. The Service

PumpedReels analyzes short-form videos you upload and produces a structured report assessing the video against a set of factors. The Service is provided for informational purposes only. The analysis represents our model’s assessment and is not a guarantee of how any video will perform on any platform.

3. Your account

You may use the Service anonymously or by creating an account with your email. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access at hello@hummelmedia.io.

4. Credits and payments

Full analysis reports are unlocked by spending credits. Credits are purchased through Lemon Squeezy, which acts as the Merchant of Record for your purchase. Lemon Squeezy is solely responsible for billing, tax handling, and refund processing. By purchasing credits, you also agree to Lemon Squeezy’s terms of service.

Credits do not expire. Credits are non-transferable between accounts. Unused credits are not redeemable for cash.

5. Refunds

Refunds are handled by Lemon Squeezy. Under EU consumer protection rules, you have a 14-day right of withdrawal for digital purchases. However, by spending a credit on an analysis, you consent to the immediate performance of the Service and acknowledge that the right of withdrawal does not apply to credits that have been used. Unused credits remain refundable within 14 days of purchase.

6. Content you upload

6.1 Ownership

You retain all rights to the videos you upload. We do not claim ownership of your content. By uploading, you grant us a limited, non-exclusive, royalty-free license to process and analyze the content solely for the purpose of providing you with the analysis report, and to store it for the retention period described in our Privacy Policy.

6.2 Your warranties

By uploading content, you warrant that:

  • You own or have the necessary rights to upload the content
  • The content does not infringe any third party’s intellectual property, privacy, or other rights
  • The content does not contain illegal material, sexually explicit content involving minors, malware, or material designed to defraud or harm

6.3 Sharing model

Each analysis is accessible via a unique URL (/v/{token}). Anyone with the link can view the analysis at the tier it was unlocked at (lite or full). You are responsible for the consequences of sharing this link.

7. Acceptable use

You may not use the Service to:

  • Upload content you do not have rights to
  • Upload illegal, harmful, or abusive content
  • Reverse engineer, scrape, or attempt to bypass rate limits
  • Resell or redistribute analysis reports as your own product
  • Attempt to gain unauthorized access to our systems or other users’ data
  • Use the Service for any purpose that violates Austrian or applicable law

We reserve the right to suspend or terminate accounts that violate these terms, without refund of unused credits in cases of serious abuse.

8. Intellectual property

The Service, including its design, content, code, factor framework, and analysis methodology, is the intellectual property of HuMe GmbH. You may not copy, reproduce, or create derivative works based on the Service.

9. Disclaimers

The Service is provided “as is” without warranty of any kind. We make no guarantee that:

  • The analysis is accurate, complete, or predictive of real-world performance
  • Acting on the recommendations will produce specific outcomes
  • The Service will be uninterrupted or error-free

Analysis results represent our model’s assessment based on a fixed rubric. Performance of any video on any social media platform depends on many factors outside our scope, and we make no representation about platform algorithms, audience response, or specific results.

10. Limitation of liability

To the maximum extent permitted by law, HuMe GmbH and its employees are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising out of these Terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be limited under Austrian or EU law, including liability for death, personal injury, fraud, or intentional misconduct.

11. Termination

You may stop using the Service at any time. You may delete your account by contacting hello@hummelmedia.io. We may suspend or terminate your account for material breach of these Terms. Termination does not affect rights and obligations that survive by their nature.

12. Changes to these Terms

We may update these Terms. Material changes will be communicated by email to registered users at least 30 days before taking effect, or by a prominent notice on the Service. Continued use after the effective date constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by Austrian law, excluding its conflict-of-laws provisions. The competent courts in Vienna, Austria have exclusive jurisdiction, subject to any mandatory consumer protection rules that grant you the right to bring proceedings in your country of residence.
